Rector's Decree n^ 813

 

THE RECTOR

Considering the Italian Law nr. 168 of 9 May 1989 and in particular Article 6 thereof;

Considering the Statute of Autonomy of the Università Politecnica delle Marche;

Considering the Italian Law nr. 241 of 7 August 1990 concerning the right of access to administrative documents and amendments thereto;

Considering the Italian Law nr. 104 of 5 February 1992;

Considering the Italian Law nr. 476/84 and subsequent amendments and additions thereto;

Considering the Italian Law nr. 335/95 and subsequent amendments and additions thereto;

Considering the Decree of the President of the Republic (D.P.R.) nr. 487 of 9 May 1994 and subsequent amendments and additions thereto;

Considering the Ministerial Decree (D.M.) of 4 October 2000 concerning the updating of the Scientific Disciplinary Sectors;

Considering the Decree of the President of the Republic nr. 445 of 28 December 2000 consolidating the provisions regulating the management of administrative documents and subsequent amendments and additions thereto;

Considering the Italian Law nr. 196 of 30 June 2003 regarding the protection of personal data, in particular articles 11 and 13;

Considering the Italian Law nr. 198 of 11 April 2006 issuing the Code on equal opportunities for men and women, pursuant art. 6 of Law nr. 246 of 28 November 2005;

Considering the Decree of the President of the Republic nr. 252 of 3 May 2006 concerning the regulation for provisions governing the legal deposit of documents of cultural interest destined to public use;

Considering the Law nr. 240 of 30 December 2010, in particular articles 22 and 29;

Considering the Ministerial Decree nr. 102 of 9 March 2011;

Considering the University Regulations governing research fellowships approved by the Governing Council during the meeting held on 5 July 2011, modified and integrated during the meeting held on 22 March 2013, in particular Art. 2, paragraph 2, letter a) that pursuant to Art. 22, par. 4, letter a) of Law nr. 240/2010 – allows the allocation of grants for “research projects autonomously submitted by the candidates for a public selection in the scientific areas of the facilities involved”;

Considering the decision of the Board of Directors of 27 June 2012 according to which € 480.000,00 have been allocated for research projects in accordance with the strategic goal of the University to promote and increase international cooperation. The allocated amount shall be spent at universities and research centres abroad, which are partners of the Università Politecnica delle Marche on the basis of a Collaboration Agreement signed by the two Institutions;

Considering the decision of the Governing Council of 3 October 2012 according to which the above-mentioned amount has been distributed to the Departments, thereby allocating, according to art. 22, par. 4, letter a) of the Italian Law Nr. 240/2010,  € 40.000,00 for each of them for one-year long research fellowships in the Scientific Areas pertaining to the same Departments, following a public selection, the call of which is also available in English;

Considering that the above-mentioned amount, including the charges to be paid by the Administration, is to be considered inclusive of travel and subsistence costs that will incur until the end of the fellowship;

Given the request by the Director of the Information Engineering Department with Order n^ 64 on 18.07.2013 with reference to the in-force cooperation agreement with the Vienna University of Technology, Faculty of Informatics, Institute of Information Systems;

Given the note attached to the Order n^ 64/2013 with which Professor Helmut Veith, employed at the above mentioned institution, agrees to welcome a researcher receiving fellowship from Università Politecnica delle Marche, that will perform his/her research activities for a period of one year under his guidance, on areas of mutual interest investigating Formal Verification of Parameterized Systems;

Whereas the Board of Directors acknowledged the above-mentioned facts in its meeting of 25 July 2013;

 

HEREBY DECREES

Art. 1 – Scope

A public selection is called for the grant of a one-year research fellowship to be spent abroad in accordance to Article 22, par. 4, letter a) of the Italian Law nr. 240/2010 and Article 2 of the existing Regulation. The public selection shall proceed on the basis of qualifications and an interview, as shown in the following table:

As far as the academic disciplines covered are concerned, reference is made to the Ministerial Decree of 4 October 2000, published in the Official Journal (Gazzetta UfficialeSerie Generale) nr. 249/2000, where such disciplines are re-determined and defined.

The administration guarantees equal opportunities for women and men, as regards access to employment and working conditions.

Art. 2 – Requirements

The admission is open to candidates who hold a PhD degree obtained in the Scientific Area mentioned in this call.

 

The candidates shall submit, along with the application, the description of a research project concerning a subject related to the area and scope of the ongoing collaboration, as stated in art. 1 of this call.

 

The candidate must give a description of:

-                      the topic or area to be investigated

-                      the methods he/she intends to use

-                      objectives and outcomes, divided in stages.

 

Each candidate shall submit one research project only.

The following are not eligible for fellowships and are therefore automatically excluded from the selection procedures: permanent employees of this and other universities, public research institutions and bodies, the National Council for New Technology, Energy and the Environment (ENEA) and the Italian Space Agency (ASI), institutions whose scientific specialisation diploma has been recognised equivalent to the title of PhD in accordance to Article 74, fourth paragraph, of the Decree of the President of the Republic Nr. 382/1980.

 

According to art. 22, par. 4, letter a) of the Italian Law nr. 240/2010, persons who are related up to and including the fourth degree of kinship or affinity or are married with a professor or researcher of the department involved in the project, or with the Rector, the General Manager or a member of the University Board cannot take part in this selection.

 

In addition to the above, candidates shall meet the following requirements to be considered eligible; they shall:

-  be physically fit for the post,

not be older than 38 years of age (age limit ends at midnight on the applicant’s birthday),

-  have a good command of the English language.

 

Citizens from other Countries shall have a qualification recognized as equivalent by the law or by an international agreement. The equivalence of the qualification shall be proved by appropriate certification.

The candidates must declare to have a good knowledge of the Italian language and specify a correspondence address.

 

All admission requirements must be met by the deadline set for the submission of the applications.

 

The admission of the candidates is subject to the review of the submitted documents. The Administration can order the exclusion of the candidate for failure to satisfy the requirements laid down, by means of a substantiated decision stating the precise reasons for the refusal. The decision shall be notified to the candidate by way of registered letter and acknowledgement of receipt.

 

The Administration is entitled to require the winners of the selection to undergo a medical examination, according to the regulations currently in force.

Art. 3 – Selection  Committee

The applications and the research projects submitted by the candidates will be examined by a Selection Committee, composed of three University Professors or Researchers, who belong to the area mentioned in Art. 1 of this call. The members of the Selection Committee are appointed after consultation of the department concerned.

Art. 4 – Evaluation criteria

The application will be evaluated on the basis of a comparative assessment of the following criteria:

-          Certificates of post-graduation specialisation courses, obtained in Italy or abroad,

-          Documents attesting that the candidate performed research activities in private and public institutions on the basis of employment contracts, scholarships or assignments (both in Italy and abroad),

Up to 40 points

 -      scientific publications,

Up to 10 points

-          Interview aimed at ascertaining the candidate’s competence in the scientific topics concerning the research project submitted and its relevance to the scientific area mentioned in this call,

-          Originality of research topic,

-          Feasibility of the project and likelihood of success to complete it within the time set.

Up to 50 points

 

Candidates are admitted to the interview only after assessment of the qualifications and publications submitted.

The project shall be presented at the premises of the University on the date to be published on the University’s website www.univpm.it under “ConcorsiConcorsi variAssegni di Ricerca”.

 

The publication of the notice on the University’s website is equivalent to all intents and purposes to a notification of the call for the interview.

On the day of the interview candidates need to submit a valid ID-document.

 

Once the interview is completed, the Committee shall give an adequately reasoned opinion on each of the candidates and draw up a general list of the admitted candidates based on the final points awarded for qualifications, publications and the project submitted and disserted, thereby determining the winner.

 

In the event of withdrawal or non-acceptance of the first candidate on the list, the Board will move on to the next ranked eligible candidate.

The candidates who will obtain a total score of at least 60 out of 100, of which not less than 30 out of 50 for the project, will be considered eligible for the fellowship.

 

The admission list will remain in effect for a period equal to one third of the whole duration of the contract and will be made public on the University-Website and on the official list of the University, Piazza Roma, 22.

Art. 5 Applications and deadlines

The applications must be drawn up on ordinary paper according to the form attached (Allegato B) and submitted to the Rector of the Università Politecnica delle Marche, Piazza Roma 22, Ancona by hand or by means of a registered letter with acknowledgement of receipt by and no later than Monday, September 23, 2013. Failure to do so will result in the application being rejected. Postmark will be taken as proof of timely sending.

 

The candidate must state clearly and precisely in the attached application form, under his/her own responsibility, in addition to name, surname, telephone, place of residence and address for correspondence (with Postcode) the following information:

1)      date of birth,

2)      type of academic title held, date and name of the awarding university,

3)      citizenship,

4)      fulfilment of any obligations imposed by the laws concerning military service,

5)      physical fitness to perform research activities,

6)      not to have any family or kinship relation up to the fourth degree and not to be married with any of the Professors or Researchers of the Department, Rector, General Manager or any members of the Board of Directors of the University,

7)      not to be holding any other fellowships of whatever kind (except for those awarded with the aim of integrating the training or the research activity of the fellowship holder, as specified in the following art. 9),

8)      to have a good knowledge of the English language,

9)      to have a good knowledge of the Italian language, for citizens from other Countries.

 

Disabled candidates can make a specific request for any aids they may need in order to sit the interview, according to the Italian Law nr. 104/92.

 

The signature on the application does not need authentication.

 

Along with the application, candidates shall submit the following documents:

-          description of a research project, expressly referring to the scientific area involved in this competition, as laid down in Article 1 of this call,

-          declaration, referred to in Articles 46 and 47 of the Decree of the President of the Republic nr. 445/2000, stating that the candidates had been awarded the required academic title, as laid down in Art. 2 of this call,

-          curriculum of the candidate’s scientific and professional activity,

-          abstract of the PhD thesis,

-          qualifications and publications in single copies, which they consider relevant for the appraisal of the application,

-          a list of the qualifications and of the publications submitted.

 

The Administration accepts no responsibility for the loss of applications or documents resulting from the inaccuracy of the data provided by the candidate in the application form, from failure or delay in the notification of a change of address, from postal service errors, or from acts of third parties, unforeseeable circumstances or force majeure.

 

For the purposes of the evaluation the candidates shall submit, along with the application, the documents attesting the awarded qualifications using the procedures provided for in the Decree of the President of the Republic Nr. 445 of 28 December 2000 on self-certification. The Allegato C attached to this call can be used for this purpose.

 

The same procedures on self-certification apply also to citizens of the European Union.

 

The possibility for non-EU citizens, who are regularly resident in Italy, to submit self-certified declarations should be limited to the cases in which conditions, facts and personal abilities can be certified or attested by Italian public or private authorities or institutions.

 

If the candidates submit photocopies of their qualifications and publications, the application should be accompanied by a statutory declaration stating that the submitted documents are certified copies of the original.

 

If the above-mentioned documents are sent or directly submitted by a person other than the candidate, they should be accompanied by an authenticated photocopy of an ID-document of the subscriber (only ID-documents with a photo and issued by a local authority are considered valid).

 

If statutory declarations are submitted without an authenticated photocopy of a valid ID-document, the candidate will be admitted to the selection, but his/her qualifications and publications will not be taken into account.

 

Date and place of publication shall be indicated for works printed abroad. Publications shall be submitted in the language of origin. If this is different from each of the following languages, the publication shall then be translated into one of these: Italian, English, French, German or Spanish.

 

The acts and documents drawn up in a foreign language, except for publications, shall be accompanied by an Italian translation certified by a competent diplomatic or consular authority or by an official translator, or – if required – by a statutory declaration stating that the submitted documents are a true translation of the original.

 

The title awarded abroad can be declared admissible by the Selection Committee, solely for purposes related to the selection of this call.

 

No reference to documents, previously submitted to this University, is allowed.

Art. 6 – Submission of documents

The winner of the selection shall submit the following documents to RIPARTIZIONE RECLUTAMENTO DOCENTI, RICERCATORI E ASSEGNI of the Università Politecnica delle Marche, via Piazza Roma n. 22 – Ancona:

 

1.       a photocopy of a valid ID-document (in lieu of certificates of birth and citizenship); a certificate of birth and citizenship for non-EU citizens.

2.        declaration certifying that the winner of the selection is not employed in this or other Universities, public research institutions and bodies, the National Council for New Technology, Energy and the Environment (ENEA), the Italian Space Agency (ASI) or institutions, the scientific specialisation diploma of which has been recognised equivalent to the title of PhD in accordance to Article 74, fourth paragraph, of the Decree of the President of the Republic Nr. 382/1980, and that he/she doesn’t perform any duties nor provide any services to the State, Province, Municipalities or private or public bodies. If this is not the case he/she shall submit a document attesting the acceptance of the new activity.

3.       declaration that the winner of the selection is not using any grants awarded and that he/she is not enrolled in any Bachelor or Master degree courses or in PhD courses with scholarship or Medical Specialization Courses in Italy and abroad or post-graduate diplomas.

 

The declarations in 2) and 3) can be made using a form issued by the RIPARTIZIONE RECLUTAMENTO DOCENTI, RICERCATORI E ASSEGNI.

 

According to articles 71 and 75 of the Decree of the President of the Republic nr. 445 of 28 December 2000, if the control made by this Administration reveals that the content of the above-mentioned statutory declarations is not true, the private law contract shall be terminated as a result of untruthful declarations.

 

According to the existing legal provisions, non-EU citizens can submit self-declarations, as the above-mentioned, for the cases in which conditions, facts and personal abilities are to be certified or attested by Italian public or private bodies or institutions.

Art. 7 – Scientific responsibility of the winning projects.

Once the forwarded documents have been approved by the Selection Committee, the department interested in the winning research project shall appoint a Professor or Researcher to act as supervisor.

Art. 8 – Termination of contract and notice

The person who has been awarded a research fellowship can terminate the contract by giving 30 days’ advance notice.

 

In the event of failure to give notice, he/she shall pay the Administration the amount equivalent to the remuneration he/she would have been entitled, hadn’t he/she failed to give due notice.

Art. 9 – Fellowship obligations

The holder of the fellowship will carry out his/her research activities, according to the short-term contract stipulated for the duration provided for in Article 1 of this call.

 

Such contract does not constitute in any way a contract of employment and does not give rise to rights in respect of access to permanent employment at the University or the public bodies mentioned in art. 2 – paragraph 2.

 

The holder of the fellowship is required to issue an activity report that will be subject to approval by the project supervisor before the fellowship expires. The Research Manager shall certify it and bring it before the Council of the interested Department for a decision.

 

In the event of a negative assessment of the ongoing research activity, the Research Manager shall submit, through the Dean, a reasoned report to the Rector, who will then give the research fellow notice of termination of the contract, that will be enforced from the first day of the following month.

 

Upon termination of the contract, the persons defined in Article 22 of the Italian Law nr. 249/10 are required to file the results of the research activity in the premises of the facility they belong to, simultaneously notifying it to RIPARTIZIONE RECLUTAMENTO DOCENTI, RICERCATORI E ASSEGNI of the University.

Art. 10 –Ban on accumulation– Incompatibility – Suspension of activity

The holder of a research fellowship is not entitled to participate in Bachelor-, Master- Doctoral-degree courses with scholarship or medical specialization courses in Italy or abroad or post-graduate diplomas.

 

For employees in public bodies other than the ones mentioned in art. 2, paragraph 2, a compulsory unpaid leave is foreseen for the whole duration of the research fellowship.

 

The research activity and the fellowship may be suspended due to compulsory military service, maternity leave or health reasons; in this case the entire duration of the research fellowship grant is not reduced due to the above suspensions.

 

An overall period of justified absence of less than thirty days in one year does not constitute suspension and consequently does not have to be made up.

Art.11 – Salary

The yearly research fellowship amounts to €33.761,00, including travel and subsistence costs. It is net of the burdens to be charged to the Administration and will be paid in deferred monthly instalments according to art.8 of this call.

 

Applicable fiscal rules are the provisions of Article 4 of the Italian Law no. 476 of 13 August 1984 and subsequent modifications and integrations. Applicable social security rules are the provisions provided for in Article no. 2, paragraph 26 and following paragraphs of the Italian law n. 335 of 8 August 1995 and subsequent modifications and integrations.

Art. 12 – Publicity

This notice of call will be published on the official list of the Università Politecnica delle Marche, in P.zza Roma n.2 – Ancona in the related Faculties and under “ConcorsiConcorsi VariAssegni di Ricerca” in the University Website http://www.univpm.it, in the MIUR-Website http://bandi.miur.it and in the website of the European Union http://ec.europa.eu/euraxess.

Art. 13 – Personal Data

In accordance with art. 11 and 13 of the Italian Legislative Decree n. 196/2003, the personal data provided by the candidates will be used exclusively for the purposes of this selection and of the awarding of the fellowship.

Art. 14 – Return of documents and publications

The candidates who failed in the selection can be returned the documents and publications they had attached to the application. The documents will be available for collection for four months from the date of assessment of their validity and in any case after the expiration of the terms for the submission of claims (60 days from the date of publication of the selection outcome on the website of Università Politecnica delle Marche). The documents can be collected by the candidate or by a person other than the candidate, at Ripartizione Reclutamento Docenti, Ricercatori e Assegni, Piazza Roma, 22 – Ancona. The candidate can also require to have the documents mailed back, thereby sending to the above-mentioned address a readable copy of the payment slip attesting the transfer of 13,00 € to the bank account of Università Politecnica delle Marche – UniCredit Banca di Roma s.p.A. – Piazza Roma 25 – Ancona (bank details IBAN: IT95P0200802626000000600882).

The documents will be returned barring any disputes being raised.

After this term, the University shall be no longer deemed responsible for the documents retained.

Art. 15 – Applicable regulation

The University Regulations and the current laws will apply to all matters not covered in the following call.
